What's the difference between a PAYG and Business Contractor?
|
GMT People looking for Contract work have the option to work under one of two arrangements:
- Business Contractors who have their own Proprietary Limited (Pty Ltd) company or Registered Business and who are engaged under a contract called a Consulting Services Agreement. Business Contractors are required to invoice GMT each pay period and are responsible for managing their own payroll and taxation affairs, including GST payments, PAYG withholdings, superannuation payments and company tax (if applicable).
- Pay As You Go (PAYG) Contractors who effectively function as temporary employees of GMT for the duration of their roles and who are engaged under a contract called an Employment Contract. PAYG Contractors do not need to invoice GMT as they automatically receive their fortnightly pay as per any normal employment arrangement. GMT will automatically deduct PAYG Installments and superannuation contributions from the daily rate and pay them on the PAYG Contractor's behalf. Details of these payments will be provided on Pay Slips and Superannuation Contribution Reports.
To demonstrate the difference between Business and PAYG Contractors the following serves as an example and is based on an agreed daily rate between GMT and the Contractor of $600 excluding GST.
Business Contractor
- A Business Contractor would receive the full $600 (in fact would invoice GMT for $600 + $60 GST which the Business Contractor must then remit to the ATO) and would then be expected to make all payments as detailed in the "Business Contractors" section above.
PAYG Contractor
- A PAYG Contractor would receive a gross daily payment of $550.45 (ie. pre-tax) of the agreed $600 daily rate. The difference of $49.55 per day ($600 - $550.45) is the amount of superannuation that is deducted from the $600 and will be paid by GMT directly into the Associate's nominated superannuation fund (ie. You get to keep the $49.55 but it gets paid into your superannuation fund). The Federal Government currently requires compulsory superannuation contributions of 9% of gross income, so the calculation is done as follows:
Gross Daily Rate = Agreed Daily Rate ÷ (1 + 0.09) where 0.09 is the decimal representation of 9%.
e.g. Gross Daily Rate = $600 ÷ (1 + 0.09) = $550.45
Working the calculation back the other way yields the following:
Super Contribution = Gross Daily Rate x 9% = $550.45 x 9% = $49.55
Since, Agreed Daily Rate = Gross Daily Rate + Super Contribution
We can see that $600.00 = $550.45 + $49.55
Therefore the PAYG contractor receives $550.45 of the total agreed daily rate before tax. GMT will then deduct from the gross daily rate of $550.45 the appropriate amount of income tax (ie. PAYG withholding) and pay that to the Australian Tax Office on your behalf.
Personal Services Income.
- Prior to making a decision on your preferred method of engagement, GMT strongly advises you to speak to your Accountant or Taxation Law Specialist in relation to the Australian Taxation Office's rulings in relation to Personal Services Income. If you nominate to be engaged by GMT as a Business Contractor, GMT will assume that your enterprise is entirely managing its own affairs in accordance with all statutory and regulatory requirements.
Further Information
- There is a significant amount of information on contracting and consulting located on the Australian Taxation Office's website at www.ato.gov.au and it is reiterated that all potential GMT Associates should seek professional advice prior to entering into any contractual arrangements.
